Leave of Absence
CHOC is dedicated in providing a supportive interactive process for your leaves of absence. Every leave of absence will be assigned a Leave of Absence Coordinator that will partner with you to manage your leave from the planning stages until your return to work.
If you must take a leave from work, CHOC provides various types of leaves of absence, depending upon your circumstance. The types of leaves are:
- Family and Medical Leave Act
- California Family Right Act
- Pregnancy Disability Act
- Medical Leave of Absence
- Personal Leave
- Worker’s Compensation
- Military or Reserve Service Leaves
- Americans With Disabilities Act
- Other Federal or State Mandated Leaves
Family and Medical Leave Act (FMLA)
To be eligible for FMLA
- Must have been employed for at least 12 months
- Must have worked at least 1,250 hours of service during the last 12 months
Leave must be for
- Own serious health condition
- Birth of a child
- Adoption or foster care of a child
- Care for spouse, child or parent with serious health condition
- Spouse, child, or parent is called to active duty or injured in the line of duty
Leave Length
- 12 weeks of unpaid leave in a 12-month period
- Can be taken either at one time or intermittently
- Will be eligible to be reinstated into the same or comparable position after leave
California Family Rights Act (CFRA)
To be eligible for CFRA
- Must have been employed for at least 12 months
- Must have worked at least 1,250 hours of service during the last 12 months
Leave must be for
- Own serious health condition (excluding incapacity due to pregnancy or childbirth)
- Birth of a child
- Adoption or foster care of a child
- Care for spouse, registered domestic partner, child or parent with serious health condition
Leave Length
- 12 weeks of unpaid leave in a 12-month period
- Will be eligible to be reinstated into the same or comparable position after leave
Pregnancy Disability Leave Law (PDL)
To be eligible for PDL
- No minimum hours requirement to be eligible for PDL
Leave must be for
- A disability caused by pregnancy
Leave Length
- 4 months (17-1/3 weeks) of unpaid leave in a 12-month period
- Will be eligible to be reinstated into the same position when return from leave
Medical Leave of Absence
- Leave must be for your own serious health condition
- Provided when you don’t qualify for FMLA, CFRA or PDL
- Provided after all FMLA, CFRA or PDL time has been used
- Up to 26 weeks of unpaid leave in a 12-month period
- Runs concurrently with all other leaves (FMLA, CFRA, PDL)
Personal Leave
- Up to 30 days, at the discretion of your supervisor
- Must have been continuously employed 6 months to qualify for this leave

Americans With Disabilities Act
- Unpaid leave and/or reasonable work accommodations is provided to individuals who have experienced a recent disabling condition or disability
- Disabling condition or disability is defined as any mental or physical impairment that limits a major life activity, i.e. seeing, walking, breathing, etc.
- Reasonable work accommodations are provided for a 90-day period or less
- Requests are evaluated by the Human Resources Department and the supervisor
- Runs concurrently with all other leaves (FMLA, CFRA, PDL, Medical)
